A security guard, Daniel Olonade, who allegedly shot a vagrant taking temporary shelter in a friend’s commercial bus in the night, was on Monday brought before an Ikeja Magistrates Court.
Olonade, 69, a resident of Erinle Street in Iju Ishaga area of Lagos, is arraigned before Magistrate T.O. Shomade for a three-count charge bordering on assault and breach of peace.
The prosecution alleged that the accused, who was hired as a night watchman in the street, found the complainant, Kayode Shoneye, sleeping in the bus at night and shot him with a double barrel gun.
Insp. Raji Akeem told the court that the accused committed the offences on Feb. 10 at Balogun Junction, Iju Ishaga.
He said the accused after beating the man with cane also shot him.
“The complainant was sleeping in his friend’s commercial bus at night when the accused questioned him.
“Shoneye explained to the security guard that he was homeless and that his friend asked him if he could sleep in his bus overnight.
“The complainant said after explaining to him he slept, thinking the accused understood what he told him.
“He said he was surprised to see the guard coming back with a cane and started beating him.
“Shoneye said when he started running for his dear life, the guard shot him,” the prosecutor told the court.
Akeem said the complainant sustained injuries on his arms and knees as a result of the gunshot.
The accused, however, denied the charges.
The offences contravened Sections 166, 171 and 244 of the Criminal Law of Lagos State, 2011.
The News Agency of Nigeria (NAN) reports that Sections 171 and 244 prescribe three years imprisonment, while Section 166 stipulates three months imprisonment or N45, 000 fine or both.
Ruling on the bail application of the accused, the magistrate granted him bail in the sum of N250,000 with two sureties in like sum and adjourned the case to March 13. (NAN)
